Aesop's Jaybles
TERMS OF SERVICE
By commissioning me, you AUTOMATICALLY agree to these terms.
Please read through before submitting any commission forms!
-
Character Rights:
a. You are expected to have full character rights of the character you are commissioning.
b. If you are commissioning a suit on behalf of another party, they are expected to have full rights of the character. I am not responsible for their dissatisfaction if they were not informed of the creation of the suit (e.g. it was a surprise gift, or if you didn’t ask for their consent/permission at all).
-
Character reference:
a. You are expected to provide a visual, SFW, HD fursuit friendly reference of your character.
This reference should have:
- Minimum 2 views
- Visibly show ALL relevant markings
- Visible mouth, tongue and teeth colors
- Have flat colors. *If it does not have flat colors, please provide a color guide or flat color palette to color pick from.
*(I have worked with people in the past who did not understand the colors of their own character because a ref sheet was shaded, which resulted in me spending extra unnecessary time fixing a “mistake” that they instructed me to make. I would expect any client making a commission of this expense to understand their own character and have enough time invested in it to provide accurate reference).
b. I will not work solely off of character descriptions unless stated otherwise.
c. Once you submit your character, the design should be set in stone. I will not accept any changes to the initial design once you’ve paid the 30% minimum deposit.
d. Cropped pornography, traced/stolen artwork, and AI generated images are not viable reference.
-
I do not make NSFW!
a. I will not create any costumes, characters or props that have explicit/obvious sexual/adult/offensive themes, or functions. If the nature of your character/request is unclear, I may ask you for clarification. If they are confirmed to be nsfw/fetish based, I will reject your commission. This doesn’t mean you can’t commission a different character though! Nor am I policing what you do with your suit or characters once it has left my hands!
b.*If you request something nsfw while deliberately lying or playing it down to pretend it is sfw to specifically undermine this rule (aka, “fetish mine”), I will block/black list you.
*It’s happened in the past and is extremely creepy, rude, and disrespectful!
-
I have the right to refuse a commission for ANY REASON.
Partially in relation to the rule above, I may reject commissions for a variety of factors, regardless if your request is sfw or not. (The reason may vary case by case!)
-
Age verification and working with minors:
a. All clients will be expected to be above the age of 18. Anyone above the age of 18 will be asked to provide photo ID verification.
b. I can work with minors! However, minors wanting to commission a suit must have their parents/guardian’s consent, and have them contact me on their behalf. Responsibility and communication will be given to the parent/guardian. The parent/guardian will then be required to send photo ID for age verification as well.
c. All costumes made for minors will be made in a template adult size (unless measurements provided are larger). Heads will come with adjustable padding to fit smaller wearers. I will not make any full suits for minors.
-
Payment:
a. I will be receiving payment via Paypal. (No exceptions).
b. When agreeing to commission me, you agree that you are able and will pay the full amount provided in the quote and it is expected that you have that money on hand (or will have it if a payment plan is agreed upon). This cannot be modified or negotiated down retroactively, after you’ve agreed. If you find you cannot pay what you agreed to pay, your commission will be canceled and you will be refunded (see the cancellation policy).
c. All clients must pay a 30% downpayment (minimum) fee in order to claim a slot and for the commission to begin.
d. You may either pay the entirety of the costs of the suit off upfront, or use a payment plan. Any offered payment plans may not be longer than 3 months (approx. length of the commission process). If you opt to use a payment plan, you must pay an initial 30% downpayment upfront in full. This is non-refundable, and I will not start the suit once I have received this payment. If you are undergoing a payment plan and miss a payment, you have 7 days to pay it off, otherwise, your commission will be canceled and turned into a premade.
e. I will not ship you your suit until it is fully paid off.
-
Turn Around Time:
a. Expect mini partials to take a minimum of 3 months to make. I do not do rush fees and cannot guarantee hitting any hard deadlines. This is not my full time job, and I do have other commitments and medical complications I need to attend to, which may make my schedule unpredictable. However, I will do my best to complete your suit in a reasonable time frame and will communicate with you throughout the process!
-
WIPs and Edits
a. I will send you “Work In Progress” pictures/videos during important milestones. Some of these milestones will need your explicit approval (specifically in text). I will not move forward unless given that approval. Please look at the WIP’s carefully so you can provide all of your feedback within one round and minimize unnecessary back and forth.
b. If you’ve missed an issue in a previous milestone, but have noticed it later, message me as soon as possible, and I will fix it!
c. I will not make any more fixes once you have approved the final product before shipping. Once the item has shipped, any requested fixes now fall under “post completion” guidelines (e.g. clause 9, right below).
d. If you do not wish to see WIPs at all, please explicitly tell me as well, and I will not send you any. However, WIPs are an important part of the process as they prevent mistakes. If you choose to not to receive WIPs, and if I have created the suit as accurate as possible according to the information you gave me at the time, I am not responsible for any cosmetic dissatisfactions as you deliberately chose to skip the WIP editing process.
-
Warranty, and Post Completion Fixes
a. All of my commissions will have a 60 day warranty! If your suit needs any repairs, you may send it back to me for fixes.
b. Warranty does not cover: damages caused by shipping carrier, misuse, or cosmetic dissatisfactions that should’ve been fixed during the WIP phase.
c. The following actions will VOID your warranty: Deliberate modifications to your suit, deliberate damage to your suit, or adult activities.
d. Any experimental features requested by the commissioner (not listed in my "will make" list) will also void the warranty.
e. Once the warranty period is over, you may still send your suit to me for fixes, but you will cover all costs. (Costs include: shipping, material costs, and labour costs).
The current påsswørd for this version of the Aesop’sJaybles TOS is: your favorite color.
Viable example: My favorite color is cosmic latte, because it’s out of this world!
Do not copy and paste the given example. Any incorrect, copied, or outdated password answers will result in your application being ignored!
-
Cancellation/refunds:
a. If you decide to cancel a commission for any reason at any point during the process, I will refund you based on the amount of work I have put into the suit and/or how far along I am in the process.
b. If you would like the materials of your incomplete suit, I will send it to you, but you must pay for shipping. If you do not want your incomplete suit, the character will be modified and turned into a premade.
c. The 30% deposit is not refundable.
-
Ghosting:
If you ghost me (read my messages but do not respond to them), or completely ignore/miss any of my communications for over 30 days, I will issue a 30 day ghost warning. If you still do not respond within another 30 days, I will cancel your commission with no refund, and turn your former commission into a premade.
-
Social Media, and ownership rights.
a. You retain the IP of your character and their design! I however, remain the creator of your fursuit, and any products I’ve made and sent you. You cannot claim you have made the suit, or anything I designed/created.
b. Credit in any personal photos appreciated, but not necessary.
c. I typically post photos of any fursuit WIPs, and final products I create on my social medias (which includes but is not limited to, my instagram, and the portfolio section of this website). If you are not comfortable with this, please contact me and explicitly tell me where you do not want your suit publicly posted.
-
Problematic behavior:
a. Anyone who exhibits extremely rude, threatening, or offensive behavior while interacting with me during the process may have their commission canceled and be blocked/blacklisted.
b. Anyone found to be exhibiting problematic behavior (including but not limited to: racism, homophobia, offensive political ideologies, zoophilia, pedophilia) will have any current commissions be canceled and be blocked and blacklisted.
c. The opinions of my clients do not reflect my own. I am not responsible, nor do I condone, a clients behavior should they act like any of the above.
-
Breaking the rules:
a. I will not make any exceptions to this TOS at your request.
b. Anyone who attempts to undermine this TOS by deliberately providing false information (e.g. lies about having character rights, lies about their age, pays with funds that are not theirs, attempts to fetish mine), will be blocked and blacklisted.
c. Any attempts to undermine this TOS and/or me to an extreme degree (e.g. you scam me) may result in me taking legal action, as TOS is legally binding.
If you have any questions about my rules or TOS, or are unsure if your materials/character are eligible, please ask me! Especially before we begin the commission process! All that I ask is that you are TRANSPARENT with your intentions!
